Article 285 provided the constitutional guarantee of Independence of Judges, and the guarantee of an Independent Judiciary to the People and State of the Maldives.
The refusal of Judicial Service Commission to honour Article 285 or to uphold its' constitutional duty and obligation to investigate complaints against judges conduct means no State apparatus exists to hold the judges accountable.
Unless Article 285 is honoured, Justice remains in the hands of a few politicians, the State cannot uphold its' constitutional duties and obligation, or promote, protect and fulfill the fundamental rights of the people, and constitutional democratic government is at risk. A security risk with wide implications that go far beyond the shores of the islands.
